La disciplina dell’hosting provider e la sua responsabilità civile alla luce del Digital Services Act

Abstract

Il contributo si sofferma sull’attività di hosting mettendo in evidenza le modifiche introdotte con il regolamento (UE) 2022/2065 (c.d. Digital Services Act) sia con riferimento al regime di esenzione dalla responsabilità che con riguardo agli specifici obblighi in materia di dovere di diligenza. Viene poi analizzata, alla luce di tale novità normativa, la figura dell’hosting provider attivo.

The paper focuses on hosting service, highlighting the amendments introduced by Regulation (EU) 2022/2065 (the so-called Digital Services Act) regarding both exemptions from liability and due diligence obligations. Furthermore, the hosting provider that plays an active role is examined.
